Hakea Prison: Rolling lockdowns stopping lawyers from talking to their clients in jail

Lawyers who have clients inside the trouble plagued Hakea Prison say it’s become near impossible to talk to their clients because of rolling lockdowns and a lack of basic electronic resources. Hakea Prison has been plagued by several disturbances in recent weeks, and on September 2 an inmate inside the jail died. Now, several Perth lawyers have blown the whistle on the woeful communication issues inside the jail — issues they claim is preventing them from even speaking to their clients. Prominent Perth defence lawyer Paul Holmes is among those who has spoken out. Mr Holmes told The West Australian Hakea Prison had long had problems with resources being properly allocated to ensure lawyers had access to their clients. But Mr Holmes said the situation had become so bad lately that a dedicated phone number legal practitioners used in order to speak to their clients was constantly going to voicemail, without the phone even ringing. When The West Australian called that number several times on Friday it went straight to voicemail. “The distinct lack of electronic resources that have been provided at the prison prevent prisoners from having a reasonable opportunity to speak to lawyers, especially on an urgent basis,” Mr Holmes said. “It is a huge problem for us because we simply cannot get hold of anyone at Hakea to arrange an official visit, arrange the service of documents or arrange for the signature of the document. “I am also aware of a practitioner who tried over 40 times to get hold of their client at Hakea, without result.” Criminal Lawyers Association of WA president Tony Elliot said Hakea Prison - in particular its “official visits” team which coordinates all official visits for prisoners - was “hopelessly understaffed.” “Sometimes there is only one person working there and that is nowhere near enough to deal with prisoner and visitor management, remote conferencing, and the large number of people seeking to make appointments,” Mr Elliot said. Experienced Perth lawyer Abigail Rogers said overcrowding and understaffing at Hakea Prison was dire. “It is also making the job of a defence lawyer much harder when we need to get instructions from a client, as official visits are limited and we have to wait days to secure a booking,” she said. In a statement the Department of Justice said it “acknowledges the increased number of remand prisoners is impacting the timely provision of services.” “The Department is evaluating potential improvements to the management of services at Hakea,” the statement added.
